Actually *fairness* is key in PvP games.
Your latest suggestion is not fair to the other players.
Lets say you have that Barb and 5 1-turn units. You attack a city with 55% chance to win. Your suggestion is that this guarantees a win for you with the loss of 4 1-turn units. So you can't lose the battle OR your hero.
Meanwhile your opponent has a Hero and 9 1-turn units because he has done a better job managing his armies. He attacks a city with his hero and 2 1-turn units with an 80% chance to win. He loses the battle entirely because he doesn't qualify for your protection.
How is that fair when you benefit by getting an automatic win just because you have fewer armies than your opponent? He did everything right including fighting at better odds and yet he gets screwed and you don't.

P.S. You can still abuse this method. Imagine you have 4 1-turn units in your stack. Elsewhere all you have is a hero and 1 1-turn unit (4 turns worth of units) so in total you have 8 turns worth of units. If you attack a city with the 4 1-turn units where you are say 55% to win you get no protection since you are allowed to lose 50% of your units before the protection kicks in. But if you disband the 1 turn unit with the hero your 4 1-turn units are now guaranteed to capture that city. Once again that makes no logical sense.
